Submission on the proposed amendments to Section 20 and 34 of the Family Violence Act 2004, February 2025

Laurel House and Engender Equality welcome the opportunity to provide feedback on the proposed amendments to Section 20 and Section 34 of the Family Violence Act 20024.

This submission has been developed in consultation and collaboration with a range of stakeholders including Lutruwita/Tasmanian victim-survivors of family, domestic, and sexual violence, children, parents and caregivers of children who have been subjected to violence, other supporters of victim-survivors, and professionals who work it the sexual and family violence sectors.

LGBTIQA+ Family Violence Practice Guidelines

Engender Equality, in collaboration with Working It Out and with support from the Tasmanian Government, are proud to announce the launch of the LGBTIQA+ Family Violence Practice Guidelines. These guidelines are designed to assist those who work with people experiencing family violence, and are the first of their kind to be written specifically for the Tasmanian context.

In addition to providing information on LGBTIQA+ fundamentals of knowledge, how family violence can present differently in LGBTIQA+ relationships, and the importance of retaining a gendered lens in this work, the guidelines also include an exciting first for the sector in the Primary Aggressor Indicators Tool. This tool gives workers a structured space to reflect on indicators of unequal power and control which can aid in identifying victim and perpetrator in non-heterosexual relationships.

This submission is in relation to the ‘consultation draft’ of Change for Children: “Tasmania’s 10 year strategy for upholding the rights of children by preventing, identifying and responding to child sexual abuse”. It has been developed utilising the practice wisdom and lived expertise of Engender Equality staff and contractors, and that of Tasmania’s Family and Sexual Violence Alliance (FSVA).

Harming or threatening pets would be a family violence offence under Tasmanian independent MPs push

Independent MP David O’Byrne is proposing a change to Tasmania’s family violence laws to include harming, or threatening to harm, animals as a form of family violence.

Support services say instances of threats to harm pets are “incredibly common” in abusive relationships.

Mr O’Byrne plans to table his proposal in state parliament this week, with the government saying it is willing to “consider” the legislation and let parliament decide.

Independent, David O’Byrne is set to table a new bill in Parliament this week aimed at protecting people and pets fleeing family violence. It comes at a time when coercive control is rife amongst communities, with Tasmania looking to fall in line with legislation in other states.
